Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ShiftPost workforce attendance service, mobile applications, and related websites (the "Service") operated by CA AND MO GROUP LLC ("ShiftPost", "we", "us"). By creating an account, signing in, or using the Service you agree to these Terms.

1. Who may use the Service

You must be at least 16 years old and legally able to enter into a contract. If you use the Service on behalf of an employer or organization (a "Customer"), you represent that you are authorized to bind that organization to these Terms.

2. Accounts and workspaces

The first user of a workspace becomes its administrator. Administrators may invite managers and employees, define worksites and schedules, and access attendance data for their workspace. You are responsible for keeping your credentials confidential and for all activity under your account.

3. Acceptable use

  • Do not impersonate another worker, share your account, or attempt to defeat GPS, selfie, QR, or device-binding checks.
  • Do not upload unlawful, harassing, or infringing content.
  • Do not reverse engineer, resell, or scrape the Service.
  • Do not use the Service to violate labor, privacy, or surveillance laws that apply to you or your workers.

4. Customer data and worker privacy

The Service processes location, selfie images, device identifiers, and attendance records ("Customer Data"). The employer/Customer is the data controller for Customer Data about its workers; ShiftPost acts as a data processor. Employers are responsible for providing lawful notice to their workers and, where required, obtaining consent. See our Privacy Policy and Data Processing Addendum.

5. Fees

Some features may require a paid subscription. Fees, billing cycles, and refund terms will be presented at purchase. Non-payment may result in suspension.

6. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law. On termination, we will delete or return Customer Data as described in the Privacy Policy and DPA.

7. Warranties and disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. GPS accuracy, device reporting, and network availability are not guaranteed.

8. Limitation of liability

To the maximum extent permitted by law, ShiftPost will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the amounts paid by you to ShiftPost in the twelve months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold ShiftPost harmless from claims arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right, including worker-notice or consent obligations.

10. Changes

We may update these Terms. If changes are material, we will provide notice through the Service or by email. Continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of State of Louisiana, USA, without regard to conflict-of-laws principles. Exclusive venue for disputes lies in the courts located in Caddo Parish, Louisiana, unless a mandatory local law provides otherwise.
